What does the expert witness in a renewable energy matters do? What credentials should a renewable energy expert have? Let’s define renewable energy first. Renewable energy refers to any energy (electricity or thermal) that is derived from a renewable resource. By definition, it includes solar energy, geothermal energy, wind energy, biomass power, biogas, renewable natural gas, and tidal energy. Renewable energy is used to produce electricity, heat, cooling, or can be used as a transportation fuel in some cases. Renewable energy litigation is as broad and varied as the field itself. Given the general lack of knowledge of the industries and their operation, the selection of expert witnesses in any renewable energy related litigation is quite often crucial to the outcome.
Renewable energy expert witnesses must have a sufficient background, education and experience in the precise type of energy in question. It is often quite helpful if the individual is a C-level former employee of a large renewable company (obviously one not involved in the litigation). Since many renewable energy legal matters involve the renewable energy technology itself, and hinge upon whether such technology was properly designed, built or installed, or was used and maintained properly, it is crucial that the expert have a working knowledge of these matters and the ability to communicate it to the trier of fact (judge or jury) in laymen’s terms. The goal is a solid understanding of exactly what went happened, why it happened, and who was at fault. It is also important that the renewable energy expert be able to help explain the damages that occurred and help the trier of fact in deciding an amount of money that will compensate.
